Information notice regarding packaging and packaging waste

eMAG Magyarország Kft., (seat: 1097 Budapest, Könyves Kálmán krt. 34., trade registry no.: 01-09-727285, tax no: 13282156-2-44), hereinafter referred to as eMAG,

 

Considering:

  • Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024 on packaging and packaging waste (hereinafter referred to as the “PPWR Regulation”);
  • The rules governing the sale of products on the eMAG Marketplace platform;

 

We hereby inform you of the following:

  • The PPWR Regulation shall apply as of 12 August 2026, following an 18-month transition period from its entry into force, with certain obligations becoming applicable gradually at later dates.
  • For the purposes of the PPWR Regulation, the notion of producer also includes a seller that, through distance contracts, offers packaged products (including the product packaging itself) directly to consumers located in a Member State, regardless of whether the seller is established in an EU Member State or in a third country.

 

Accordingly, under these provisions, you are subject to the following obligations:

  1. Registration in the national producer register. Registration in the producer register of each Member State where packaging or packaged products are first placed on the market is mandatory. In the absence of such registration, marketing such products is not lawful.
  2. Fulfilment of Extended Producer Responsibility (EPR) obligations. You are required to fulfil extended producer responsibility obligations for packaging placed on the market, including the payment of financial contributions related to waste management, either directly or through a producer responsibility organization.
  3. Appointment of an authorised representative, where applicable. If you place packaging or packaged products on the market in a Member State where you are not established, you may be required to appoint an authorised representative to fulfil your extended producer responsibility obligations.
  4. Provision of compliance information to the platform. Upon the platform’s request, you must provide proof of registration in the producer register and a self-declaration confirming compliance with extended producer responsibility obligations for packaging offered to consumers in the relevant Member State.
  5. Responsibility for the accuracy of information. Under the Regulation, the producer is responsible for the accuracy of the information provided. Accordingly, you are required to ensure that such information remains complete, accurate and up to date.
  6. Compliance of packaging with sustainability and labelling requirements. To the extent that you act as the manufacturer or importer of packaged products, packaging placed on the market must comply with the Regulation’s requirements regarding recyclability (design for recycling), minimum recycled content in plastic packaging, restrictions on substances of concern (including the applicable limits for PFAS substances in food-contact packaging), and harmonised labelling requirements concerning material composition and separate collection.
  7. Packaging minimisation and limitation of empty space. Packaging must be reduced to the minimum volume and weight necessary to ensure its functionality. For grouped packaging, transport packaging and e-commerce packaging, the empty space ratio must not exceed 50%.
  8. Preparation of the Declaration of Conformity and technical documentation. You must prepare and retain the Declaration of Conformity and the technical documentation demonstrating compliance of each type of packaging with the requirements of the Regulation. These documents must be available no later than 12 August 2026.

 

Timeline for Application

The majority of obligations set out in the Regulation shall apply from 12 August 2026.

However, certain obligations will apply progressively at later dates:

  • Requirements related to harmonised labelling and digital labelling (for example, QR codes) will apply from 2027.
  • Certain requirements relating to recyclability, minimum recycled content, reuse targets, and empty space limitations will apply from 1 January 2030, with additional targets introduced in subsequent years.

As a provider of an online platform service, eMAG is required to verify your compliance with the provisions of the Regulation.

However, the verification obligation described under point 4 above cannot currently be effectively implemented, as the public producer registers and official data-reconciliation interfaces are not yet operational.

Therefore, for the time being, the only requirement imposed by eMAG is the submission of the above-mentioned Self-Certification Declaration, which will be made available in your eMAG Marketplace account.

We will inform you in due course of the date on which the verification obligation becomes effective, as well as of the information and documents that you will be required to provide to the platform, as public registers and verification interfaces become available in each relevant Member State.

 

Consequences of Non-Compliance

Packaging and packaged products that do not comply with the requirements of the PPWR Regulation may not be lawfully placed on the EU market.

The Regulation requires Member States to establish effective, proportionate and dissuasive penalties for infringements of its provisions. In practice, non-compliance may result in market surveillance measures, marketing prohibitions, withdrawal or removal of products from online platforms (delisting), as well as administrative fines imposed at the level of each member state.

Furthermore, failure to comply with your obligations may lead to restrictions on, or suspension of, your ability to market products through the eMAG Marketplace platform.
